Terms of Service

1. Who can use the app

You must be at least 13 years old to use Level Up!. By using the app, you confirm that you meet this requirement. If you are under 18, you should have permission from a parent or guardian.

2. Your account

You are responsible for keeping your login credentials secure. Do not share your password with anyone. If you think your account has been compromised, contact us immediately at n1ch0lasd4k1s@gmail.com.

You agree to provide accurate information when creating your account. Fake accounts and impersonating someone else are not allowed.

3. Acceptable use

You agree not to:

• Reverse engineer, decompile, or tamper with any part of the app.
• Exploit bugs or glitches for any unfair advantage.
• Scrape or extract data from the app in an automated way.
• Use the app for anything illegal or harmful.
• Attempt to gain unauthorized access to our servers or other users' accounts.
• Use profanity, offensive language, or impersonation in your username or any user-generated content.
• Use bots, scripts, or automated tools to interact with the app.
• Spoof your GPS location to fraudulently claim Explore check-ins or XP rewards.

Cheating or abusing game mechanics may result in account suspension or permanent termination at our sole discretion.

4. Your data

You own your personal data, including your food logs, workout logs, water and weight entries, and health info. By using the app, you give us permission to store and process that data solely for the purpose of running Level Up! and providing its features to you. We do not sell your data. See our Privacy Policy for full details on how your data is handled.

5. Profile pictures

You may upload a profile picture to personalize your account. By uploading an image, you confirm that you have the right to use it and that it does not contain offensive, explicit, hateful, or infringing content. Profile pictures that violate these terms may be removed and your account may be suspended or terminated at our sole discretion.

6. Community content and public routines

Level Up! includes a community routine library. Routines you create may be selected by the developer to appear in the community library, making them visible and usable by all users. By creating a routine, you acknowledge that it may be featured publicly in this way.

Once a routine is part of the community library, it cannot be edited or deleted. This ensures that all users who have saved or started using it can continue to do so. The routine will remain available even if you later delete your account, but will be fully disassociated from your account and displayed under a generic author placeholder.

We reserve the right to remove community routines that violate these terms or our content policies.

7. Subscriptions and purchases

Level Up! offers an optional Pro subscription that unlocks additional features. Subscriptions are billed through Google Play and are subject to Google Play's terms and refund policies. Subscription pricing is displayed before purchase and may vary by region.

You can cancel your subscription at any time through your Google Play account. Cancellation takes effect at the end of the current billing period. We do not issue refunds for partial billing periods except where required by law.

Pro features such as streak shields are consumable monthly allowances. Unused shields do not roll over between months. Streak shields are a feature of the app and have no monetary value outside of it.

If your subscription lapses or is cancelled, Pro features will be removed at the end of the current billing period. No partial refunds are issued for unused time.

8. Referrals

Level Up! includes a referral system that rewards both the referrer and the referred user with XP when certain conditions are met. Referral rewards are subject to eligibility requirements and may be modified or discontinued at any time. Attempting to abuse the referral system, including self-referrals or coordinated reward farming, may result in account suspension.

9. Ads

The app shows ads on Android served by Google AdMob and Unity Ads. Watching a rewarded ad is always optional. XP rewards earned from watching ads are granted after server-side verification of the ad completion. We reserve the right to adjust ad reward amounts at any time.

10. Our content

The Level Up! app, its design, branding, code, and features are owned by Nicholas Dakis. You may not copy, reproduce, or distribute any part of the app without permission.

11. Not medical advice

Level Up! is a personal tracking and gamification tool. It is not a medical app, and nothing in it should be taken as medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making significant changes to your diet or exercise routine. We are not responsible for decisions you make based on data logged in the app.

12. Termination

We reserve the right to suspend or terminate your account at any time, at our sole discretion, with or without notice, including but not limited to violations of these terms.

To request account deletion, email n1ch0lasd4k1s@gmail.com. See the account deletion page for more information. All associated data will be removed, except for public routines which remain in the community library as described in section 6.

13. Limitation of liability

Level Up! is provided as-is. We do our best to keep the app running smoothly, but we cannot guarantee it will always be available or error-free. To the fullest extent allowed by law, Nicholas Dakis is not liable for any damages arising from your use of the app.

14. Changes to these terms

We may update these terms from time to time. If we make significant changes, we will update the "Last Updated" date above and may notify you in-app. Continued use of the app after changes means you accept the updated terms.

15. Dispute resolution

Any dispute arising out of or relating to these terms or your use of Level Up! will be resolved through binding individual arbitration under the rules of the American Arbitration Association, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

16. Disclaimer of warranties

Level Up! is provided "as-is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components.

17. Indemnification

You agree to indemnify and hold harmless Nicholas Dakis from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of your use of Level Up!, your violation of these terms, or any content you submit or actions you take within the app.

18. Severability

If any provision of these terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

19. Entire agreement

These terms, together with the Privacy Policy, constitute the entire agreement between you and Nicholas Dakis regarding your use of Level Up! and supersede any prior agreements or understandings on the same subject.

20. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict of law provisions.

21. Copyright and DMCA

If you believe that content on Level Up! infringes your copyright, please notify us at n1ch0lasd4k1s@gmail.com with a description of the content, your contact information, and a statement that you have a good-faith belief the use is unauthorized. We will remove infringing content upon valid notification.
